1. Definitions
1.1 'We' are Bedazzled Designs of Hornchurch, Essex RM11 1WU
1.2 'You' are the consumer who has placed an order for goods from the Bedazzled Designs website at www.bedazzleddesigns.com
2. The contract between us
We must receive payment of the whole of the price for the goods that you order together with the packaging and delivery charge before your order can be accepted. Once payment has been received by us we will notify you by e-mail once your order has been dispatched to confirm that your order has been accepted. Our acceptance of your order brings into existence a legally binding contract between us.
3. Price
3.1 The prices payable for goods that you order are as set out in our website.
3.2 The prices are inclusive of VAT.
4. Packaging and delivery charge
You will be required to pay, in addition to the total of the prices of the goods contained in your order, the following amount per order for packaging and delivery:
4.1 A postage & packing charge of £1.99 will be added to orders up to £14.99 which includes 1st Class Post. Postage & packing is free on orders totalling £15.00 or more;
4.2 If the package is too large to be sent by Royal Mail delivery post, the reasonable costs of a courier will deliver your order.
5. Payment
5.1 Payment must be made by one of the following methods:
5.1.1 Debit or credit card
5.2 Where payment is made by a method in clause 5.1.1 above, the goods can only be delivered to the address of the cardholder.
6. Right for you to cancel your contract
6.1 You may cancel your contract with us for the goods you ordered at any time up to the end of the seventh working day from the date you received the ordered goods.
6.2 You cannot cancel your contract if you have taken the goods out of the sealed package in which they were delivered to you and/or the goods are no longer in a saleable condition.
6.3 To cancel your contract, unless under clause 6.2 you do not have a right to cancel, you must:
6.3.1 send the goods back to our contact address at your own cost and risk; and
6.3.2 send with the goods a note stating your reason for returning the goods and whether you require replacement of the good by us or a refund.
6.4 Provided that the goods in question are returned to us under clause 6.3 in the condition they were in when delivered to you, we will, unless you ask us to replace the goods under clause 6.3.2, within 20 working days of our receipt of the goods:
6.4.1 re-credit to your account the price of the goods
7. Cancellation by us
7.1 We reserve the right to cancel the contract between us if:
7.1.1 we have insufficient stock to deliver the goods you have ordered;
7.1.2 we do not deliver to your area;
7.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
7.2 If we do cancel your contract we will notify you by e-mail and we will as soon as possible but in any event within 30 working days of your order:
7.2.1 re-credit to your account any sum deducted by us from your credit card
8. Delivery of goods to you
8.1 We will deliver the good ordered by you to the address:
8.1.1 of the cardholder if you paid by a method in 5.1.1; or
8.1.2 supplied by you on filling out the required details at the checkout if you paid by a method in clause 5.1.2.
8.2 Delivery will be by:
8.2.1 first class recorded delivery post by Royal Mail wherever possible;
8.2.2 courier if delivery is not possible under clause 8.2.1.
8.3 Delivery will be made as soon as possible after your order is accepted and in any event within 10 working days of the date on which you ordered the goods. Once your order has been dispatched please allow up to 28 working days for delivery.
8.4 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
9. Liability
9.1 If the goods delivered are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within seven working days of the delivery of the goods in question.
9.2 If you do not receive the goods ordered by you within 10 working days of the date on which you ordered them, we have have no liability to you unless you notify us in writing at our contact address of the problem within 15 working days of the date on which you ordered the goods.
9.3 If you notify a problem to us under condition 8.1, our only obligation will be, at your option:
9.3.1 to make good any shortage or non-delivery; or
9.3.2 to replace or repair any goods that are damaged or defective; or
9.3.3 to refund to you the sum paid by you for the goods, including the price and package and delivery charge, in whatever way we choose.
9.4 If you notify a problem to us under condition 9.2, our only obligation will be:
9.4.1 to deliver to you the same goods that you ordered at your own cost of posting and package;
9.4.2 to refund the price and packaging and delivery charge less a 50p administration charge PROVIDED that we have tried to deliver to you twice at your own cost and both times the package has been returned to us.
9.5 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under conditions 9.1 or 9.2 and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 9.3.3 above.
9.6 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the good you purchase.
9.7 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
10. Notices
All notices from you to us must be in writing and sent to our contact address at: Bedazzled Designs, P O Box No. 4270, Hornchurch, RM11 1WU; and all notices from us to you will be by email to the email address you supply us with on filling out the required details when you proceed to the checkout, unless otherwise expressly stated in these terms and conditons.
11. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
12. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
13. Privacy
We will use information obtained from you consistent with the Data Protection Act 1998 and we will not disclose that information to any third party save as required by law to do so.
14. Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have sole jurisdiction to resolve any dispute between us. You irrevocably submit to the jurisdiction of the Courts of England and Wales.
15. Entire agreement
These terms and conditions, together with our current website prices and contact details set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
Minimum Order - Minimum Order £5 before P&P.
Sizes - Please note all sizes quoted within this website are approximate.
Choking Hazards - Please be aware that many of the items sold by Bedazzled Designs are small, or easily broken into small parts, and could constitute a choking hazard. We strongly advise you to keep these items away from small children. Our products are sold as craft and decorative items, NOT as toys.
